Alcohol licensing attorneys for Gainesville restaurants, bars, package stores, and producers
Gainesville rewrote its alcohol ordinance in August 2024. Under Chapter 6-4, a complete application is approved administratively by the city manager or designee rather than at a council hearing, package liquor stores must sit 500 yards apart, and every server needs a three-year employee permit. Miles Hansford handles the city application, the state license, and what follows.
The firm represents restaurants and bars on the downtown square, package stores, grocers, hotels, breweries and distilleries, private clubs, and venues around Lake Lanier. Gainesville's ordinance is broader than Hall County's, so concepts the county will not license are often possible inside the city. Our Gainesville land use and zoning attorneys handle any rezoning or special use permit the site needs.

An administrative approval under Chapter 6-4, not a council vote
The City Council adopted a rewritten Chapter 6-4, Alcoholic Beverages, on August 6, 2024. Under it, the city manager administers the chapter and, through designated staff, approves complete applications; a compliant application does not go to a council hearing. Day-to-day handling runs through the Business Tax & Licensing Division of the Office of Financial Services, which processes applications, investigates new applicants, and enforces excise taxes.
The ordinance covers malt beverage, wine, and distilled spirits licenses for package and on-premises sales, along with breweries, brewpubs, distilleries, Georgia farm wineries, private clubs, special event facilities, temporary limited licenses, and caterer event licenses. Fees are due at filing and are halved after July 1. Once the city license issues, the state license is finalized through the Georgia Tax Center.
- Distance check under §§ 6-4-60, 6-4-70, and 6-4-80
- Managing agent who is 21, a citizen or permanent resident, and a Georgia resident
- Fingerprinting and criminal background check for the applicant
- Administrative approval by the city manager or designee

What Gainesville owners need to know under the 2024 ordinance
The rewrite changed who approves licenses and added rules that did not exist before.
The Gainesville approval path, step by step
Confirm the location against the distance rules for your license class. Designate a managing agent who is at least 21, a citizen or lawful permanent resident, a Georgia resident, and has day-to-day authority over the business. File the application with the fee through Business Tax & Licensing, complete fingerprinting under the city's procedure, and clear the criminal background check. If the application is complete and compliant, the city manager or designee approves it; there is no council hearing. The state license then follows through the Georgia Tax Center.
Distance rules, including the 500-yard liquor-store spacing
Package beer and wine may not be sold within 100 yards of a school building, school grounds, or college campus (§ 6-4-60). Package liquor may not be sold within 100 yards of a church or 200 yards of a school or college, and a new or relocated package liquor store must be at least 500 yards from any other (§ 6-4-70). On-premises licensees may not be within 100 yards of housing authority property of 300 or fewer units (§ 6-4-80). Caterers were later exempted from the 100-yard school rule. These track O.C.G.A. § 3-3-21, measured by the most direct route of travel.
Employee permits, Sunday hours, and to-go rules
Anyone who dispenses, serves, or mixes alcohol needs a city employee permit, valid for three years (§ 6-4-12). Sunday package sales of beer, wine, and liquor run 11:00 a.m. to 11:30 p.m., and Sunday on-premises sales run from 11:00 a.m. Sunday to 1:30 a.m. Monday (§§ 6-4-61, 6-4-71, 6-4-81). The 11:00 a.m. start is the earlier Sunday hour Georgia's 2018 brunch bill made available by referendum; cocktails-to-go were authorized statewide by SB 236 in 2021.
Renewals, show-cause hearings, and appeals
Every license expires at midnight on December 31. The renewal application is due on or before November 15 and the fee by December 15, with a 10% late penalty (§ 6-4-6(b)); the state window runs September through December 31. Denials and violations go to a show-cause hearing before an administrative hearing officer on not less than 3 nor more than 30 days' notice (§ 6-4-11), with review in superior court afterward, which since July 2023 generally proceeds by petition for review under O.C.G.A. § 5-3-1 et seq. within 30 days, on the record.
Licensing counsel that reads the new ordinance, not the old one
Miles Hansford's Alpharetta office is a short drive up GA 400 and I-985 from downtown Gainesville. The regulatory and government law practice, led by partner David Davidson, also offers government representation, which matters under an ordinance that puts approval in the hands of city staff.
Because the city and Hall County run separate ordinances with different rules on bars, package liquor, and hearings, we confirm jurisdiction first. Learn more about our alcohol licensing practice across North Georgia.

Gainesville alcohol licensing FAQs
Does a Gainesville alcohol license require a City Council hearing?
Not for a complete and compliant application. Under Chapter 6-4 as adopted August 6, 2024, the city manager or designee approves applications administratively, with day-to-day handling by the Business Tax & Licensing Division. That makes a well-prepared file the fastest path to a license. Denials and violations go to a show-cause hearing before an administrative hearing officer.
How far apart must package liquor stores be in Gainesville?
A new or relocated package liquor store must be at least 500 yards from any other package liquor store under § 6-4-70, in addition to 100 yards from a church and 200 yards from a school or college. Package beer and wine stores must be 100 yards from a school under § 6-4-60. Distances are measured by the most direct route of travel.
Do Gainesville servers and bartenders need a permit?
Yes. Anyone who dispenses, serves, or mixes alcoholic beverages in Gainesville needs a city employee permit under § 6-4-12, which is valid for three years. We build the permit process into onboarding so a new hire is cleared before serving, and we track expirations across the staff.
What are Sunday alcohol hours in Gainesville?
Package sales of beer, wine, and distilled spirits run from 11:00 a.m. to 11:30 p.m. on Sunday. On-premises sales run from 11:00 a.m. Sunday until 1:30 a.m. Monday. The 11:00 a.m. start reflects the brunch-bill hours available to Georgia communities since 2018.
When is a Gainesville alcohol license renewal due?
The renewal application is due on or before November 15 and the fee by December 15, with a 10% late penalty under § 6-4-6(b). Every license expires at midnight on December 31. The state renewal window at the Georgia Department of Revenue runs from September through December 31, and the Department recommends filing by November 1.
How do I appeal a Gainesville alcohol license denial or suspension?
Chapter 6-4 provides a show-cause hearing before an administrative hearing officer on not less than 3 nor more than 30 days' notice, with review in superior court afterward. Since July 2023 that review generally proceeds by petition for review under O.C.G.A. § 5-3-1 et seq., filed within 30 days and decided on the record.
Can I open a bar or package liquor store in Gainesville when Hall County does not allow them?
Inside the city limits, Chapter 6-4 licenses distilled spirits for both package and consumption sales, subject to the city's own distance and spacing requirements and any operating standards in the chapter. Unincorporated Hall County does not permit bars or packaged distilled spirits. We confirm the parcel's jurisdiction and whether your concept qualifies before any application is prepared.
