Alcohol licensing attorneys for Hall County restaurants, retailers, and caterers
In unincorporated Hall County, every new alcohol license goes to a public hearing before the Board of Commissioners, restaurants must meet a 30-seat and two-meal-period test, and bars and package liquor stores are not permitted. Miles Hansford handles the county application, the hearing, the state license, and the November 15 renewal.
The firm represents restaurants, grocers and convenience stores, caterers, wine-tasting venues, and event businesses across South Hall, East Hall, and the Lake Lanier shoreline. Hall County's ordinance is one of the more restrictive in North Georgia. Our Hall County land use and zoning team handles any rezoning or special use the location needs.

Business License Division intake, then a Board of Commissioners public hearing
Hall County's Business License Division at 2875 Browns Bridge Road, third floor, in Gainesville accepts new alcohol applications until 4 p.m. each day. The ordinance is in Chapter 5.30 (Malt Beverages and Wine) and Chapter 5.60 (Distilled Spirits Code). Every new license is approved by the Board of Commissioners at a public hearing during a voting meeting; the Board's meetings have been held on the second and fourth Thursdays at 6 p.m.
Two features set Hall County apart. Packaged distilled spirits are not sold in unincorporated Hall County because voters have not approved them, so package licenses cover beer and wine only. And businesses that sell only alcohol are not allowed; a consumption license requires a restaurant with a sanitary kitchen, at least 30 seats, meals during at least two meal periods, and operation at least three days a week and six months a year. A current certificate of occupancy and business license are prerequisites.
- Restaurant qualification: kitchen, 30 seats, two meal periods, three days a week
- Distance check: 300 feet from a church structure, 600 feet from a school
- Applicant qualifications and Criminal History Consent Form
- Board of Commissioners public hearing on the agenda cycle

What Hall County owners need to know
The county FAQ is direct about what it will not license. These rules decide most applications.
The Hall County approval path, step by step
Secure a current certificate of occupancy and county business license first; both are prerequisites. Confirm the location clears 300 feet from the nearest point of a church's main structure and 600 feet from schools. File with the Business License Division before 4 p.m., with the Criminal History Consent Form and, for out-of-county owners, a local registered agent. The license is then heard at a Board of Commissioners public hearing during a voting meeting. After county approval, the state license is finalized through the Georgia Tax Center.
The restaurant test and the no-bar rule
A consumption-on-premises license in unincorporated Hall County is available only to a restaurant with a sanitary kitchen, at least 30 seats, meals during at least two meal periods, and operation at least three days a week and six months a year. Bars and package stores are not allowed, and packaged distilled spirits are not sold because voters have not approved them. Once licensed, the county prohibits special pricing such as happy hours and prohibits brown-bagging, and all product must come through a licensed wholesaler.
Sunday hours and applicant qualifications
Sunday package sales run 12:30 p.m. to 11:30 p.m., and Sunday on-premises sales run 11:00 a.m. to 11:30 p.m. Applicants must be at least 21, a U.S. citizen or documented resident, and a Georgia resident; a non-Hall County resident must designate a local registered agent. A felony within 10 years or a misdemeanor, including DUI or BUI, within 5 years disqualifies. If the agent changes, the county must be told within 5 days or the fee doubles, and after 90 days the license is invalid.
Renewals, violations, and appeals
Every Hall County license expires December 31. The county mails a renewal application in October, due with payment by November 15; the state window runs September through December 31. For sales to minors, a second offense carries a mandatory 30 to 90 day suspension and a third brings revocation. A licensee is entitled to written reasons and, on timely request, a hearing under O.C.G.A. § 3-3-2. A final county decision is reviewed in superior court by petition for review under O.C.G.A. § 5-3-1 et seq., generally within 30 days.
Licensing counsel for the Lake Lanier and I-985 corridor
Miles Hansford's Alpharetta office is a short drive up GA 400 and I-985 from the Hall County Government Center on Browns Bridge Road. The regulatory and government law practice, led by partner David Davidson, also offers government representation for cities, counties, and authorities, so licensing advice is informed by how a county processes and hears these files.
Because Hall County and the City of Gainesville run separate ordinances, we confirm jurisdiction first and then apply the right rulebook. Learn more about our alcohol licensing practice across North Georgia.

Hall County alcohol licensing FAQs
Can I open a bar in unincorporated Hall County?
No. Hall County does not allow businesses that only sell alcoholic beverages, which includes bars and package stores. A consumption-on-premises license is available to a restaurant with a sanitary kitchen, at least 30 seats, meals during at least two meal periods, and operation at least three days a week and six months a year. Inside Gainesville, the city's ordinance applies.
Does Hall County allow package liquor sales?
Not in unincorporated Hall County. Voters have not approved the sale of packaged distilled spirits, so a package license covers beer and wine only. Distilled spirits by the drink are available under a consumption-on-premises license held by a qualifying restaurant. The City of Gainesville licenses package liquor under its own ordinance.
How far must a Hall County restaurant or store be from a church or school?
The county requires at least 300 feet from the nearest point of a church's main structure and 600 feet from schools. State law under O.C.G.A. § 3-3-21 adds its own church and school distances for distilled spirits, beer, and wine, measured by the most direct route of travel. We verify both before a lease is signed.
Does my Hall County alcohol license require a public hearing?
Yes. Hall County alcohol licenses are approved by the Board of Commissioners at a public hearing during a voting meeting. The Board has met on the second and fourth Thursdays at 6 p.m. We place the application on the agenda cycle, prepare the file, and present at the hearing.
What are Sunday alcohol hours in Hall County?
In unincorporated Hall County, Sunday package sales of beer and wine run from 12:30 p.m. to 11:30 p.m., and Sunday on-premises sales run from 11:00 a.m. to 11:30 p.m. The county also prohibits happy-hour pricing and brown-bagging under any license, on any day.
When is my Hall County alcohol license renewal due?
Every Hall County license expires December 31. The county mails a renewal application in October, and it is due back with payment by November 15. The state renewal at the Georgia Department of Revenue runs from September through December 31, and the Department recommends filing by November 1, so both renewals should be handled together.
What happens after a sale to a minor in Hall County?
The employee faces a misdemeanor, and the license is subject to county action. A second offense carries a mandatory suspension of 30 to 90 days, and a third results in revocation. You are entitled to written reasons and a hearing, and a final decision is reviewed in superior court by petition for review, generally within 30 days.
