Did you know that in Georgia, if you are convicted of a Family Violence Offense, you could lose your right to possess a firearm for life?

In Georgia, a family violence offense is an offense committed against one of the following:

  • A current or former spouse
  • Parents of the same child
  • Parents and children
  • Stepparents and stepchildren
  • Individuals that live or have lived in the same household

In Forsyth County, Georgia, if you are arrested for a family violence offense you will likely be held in custody for at least twenty-four (24) hours before your First Appearance Hearing. At a First Appearance Hearing for a family violence offense, it is not abnormal to have any of the following bond conditions put in place:

  • No contact with the alleged victim
  • Not returning to the residence of the alleged victim
  • Surrender of any firearms
  • No alcohol or drugs
  • Reporting to Pre-Trial Services

If you are convicted of or enter a guilty plea to a first offense of family violence penalties could include:

  • Up to twelve (12) months in jail
  • Up to a $2,500 dollar fine plus surcharges
  • Twelve (12) month probation
  • Completion of a Family Violence Intervention Program
  • Community Service Work
  • Firearm surrender
  • No alcohol or drugs for the duration of probation

Moreover, if you are not a U.S. citizen it could impact your immigration status. If you or a loved one has been charged with a family violence offense it is essential you seek legal counsel. Please do not hesitate to call Brian A. Hansford and the criminal defense team at Miles Hansford Law Firm.
