Land Use & Zoning · Forsyth County

Land use, zoning, and rezoning attorneys for Forsyth County property owners and developers

Forsyth County rezonings run through a Planning Commission hearing and a Board of Commissioners vote under Chapter 8 of the Unified Development Code, with a mandatory applicant-hosted public participation meeting first. Miles Hansford represents applicants and neighbors at every step, including the 30-day superior court window that follows.

Forsyth County has grown roughly 66% since 2010 to about 280,000 residents, and has responded with a 2022–2042 Comprehensive Plan, a residential rezoning moratorium, and a rewrite of its 374-page UDC. We handle rezonings, conditional use permits, variances, and sketch plats in that environment, alongside our Forsyth County alcohol licensing work for restaurants, breweries, and venues.

How Forsyth County Handles It

Planning & Community Development, the Planning Commission, and the Board of Commissioners

Zoning in unincorporated Forsyth County is administered by Planning & Community Development at 110 E. Main Street in Cumming through the county's CSS portal. The governing code is the Unified Development Code, Appendix A to the Code of Ordinances; Chapter 8 sets the application procedures. Rezonings go to the Planning Commission for a recommendation and to the Board of Commissioners for decision; the Board also decides conditional use permits and sketch plats.

Every rezoning is measured against the Comprehensive Plan 2022–2042, which revised the future land use maps and removed mixed-use and M2 zoning from some areas. From April 2025 into 2026 the county also operated under a residential rezoning moratorium while it rewrites the UDC, so the first question on a residential project is whether it can be filed at all.

  • Zoning review meeting, then 10 to 180 days to finalize the site plan
  • Applicant-hosted public participation meeting at least 12 days later
  • Legal notice 15 to 45 days and signs 21 to 45 days before the hearing
  • Campaign contribution disclosure within 10 days of filing (§ 36-67A-3)

In Depth

How rezoning works in Forsyth County, and what is different here

The county follows the state Zoning Procedures Law and layers stricter requirements on top.

The Chapter 8 process, step by step

After an application is accepted, staff schedules a zoning review meeting. The applicant then has 10 to 180 days to finalize the site plan and hold the public participation meeting, no earlier than 12 days after the review meeting. Legal notice runs 15 to 45 days before the hearing and signs go up 21 to 45 days ahead. The Planning Commission issues a recommendation by its next regular meeting or 31 days after its hearing, whichever is later. The Board of Commissioners then hears the case and votes under the § 8-5.5(f)(2) criteria, starting with Comprehensive Plan conformity.

Conditional use permits, variances, and the 2023 procedures update

Conditional use permits are decided by the Board of Commissioners. Most variances go to the Zoning Board of Appeals, whose decisions are final unless an aggrieved person petitions the Board of Commissioners within 10 days; variances affecting four or more subdivision lots go directly to the Board. In 2023 the county conformed its procedures to HB 1405: quasi-judicial items now require 30 days' notice plus direct mail, and lot-size variances are capped at 10%, or 25% for lots adjacent to Lake Lanier.

The Comprehensive Plan, the moratorium, and the UDC rewrite

The Comprehensive Plan 2022–2042 is the first test for any rezoning. In April 2025 the Board adopted a residential rezoning moratorium (resolution dated May 15, 2025) while it rewrites the UDC, extended in 180-day increments into 2026, plus a sketch-plat and land disturbance moratorium extended December 4, 2025. In February 2026 the chairman indicated the Res-1 and Res-2 categories might be released first; the moratorium's current status is confirmed with the firm before any filing. Growth continues along GA 400 and Highway 9: The Crossing at Coal Mountain broke ground in July 2025, and The Gathering at South Forsyth is planned as a roughly $2 billion mixed-use district. The county also bars data-center cooling from using county water.

Opposing a rezoning and appealing a decision

A denied rezoning cannot return in substantially similar form for 12 months under UDC § 8-2.3, twice the six-month bar in O.C.G.A. § 36-66-4(c). Any challenge must be filed in superior court within 30 days of the written decision under § 36-66-5.1: rezonings are reviewed de novo, with the challenger required to show by clear and convincing evidence that the classification is a significant detriment and insubstantially related to the public welfare; variances and conditional use permits are reviewed on the record. Applicants who gave $250 or more to a deciding official within two years must disclose within 10 days of filing under § 36-67A-3.

Frequently Asked Questions

Forsyth County zoning and rezoning FAQs

Who decides rezonings in Forsyth County?

The Forsyth County Board of Commissioners decides rezonings, conditional use permits, and sketch plats after a Planning Commission recommendation. Most variances are decided by the Zoning Board of Appeals, with a 10-day petition to the Board of Commissioners available to an aggrieved party. Property inside the City of Cumming is zoned by the city.

Do I have to hold a neighborhood meeting before a Forsyth County rezoning hearing?

Yes. UDC Chapter 8 requires an applicant-hosted public participation meeting for rezonings and conditional use permits, held no earlier than 12 days after the zoning review meeting with staff. The applicant has 10 to 180 days after that review meeting to finalize the site plan and complete the participation plan.

Is there a rezoning moratorium in Forsyth County?

Forsyth County adopted a residential rezoning moratorium in April 2025 while it rewrites the Unified Development Code, extended in 180-day increments, with a separate sketch-plat and land disturbance moratorium extended in December 2025. Leadership discussed releasing the Res-1 and Res-2 categories in early 2026. Confirm current status before planning a filing.

How long do I have to wait to re-file a denied rezoning in Forsyth County?

Twelve months. UDC § 8-2.3 bars a substantially similar application on the same property for at least 12 months after a denial, which is stricter than the six-month minimum in O.C.G.A. § 36-66-4(c). A materially different application may be possible sooner, but the county decides what counts as substantially similar.

When must hearing signs go up in Forsyth County?

For rezonings and conditional use permits, signs must be posted at least 21 and not more than 45 days before the hearing, and the legal advertisement runs 15 to 45 days ahead. Variances and sketch plats require signs at least 30 days before the hearing, plus mailed notice under the county's 2023 procedures.

How do I appeal a Forsyth County zoning decision?

A Zoning Board of Appeals decision can be taken to the Board of Commissioners by petition within 10 days. Any challenge to a final decision must be filed in superior court within 30 days under O.C.G.A. § 36-66-5.1. Rezonings are reviewed de novo under a clear-and-convincing standard; variances and conditional use permits are reviewed on the record.

Can neighbors stop a rezoning in Forsyth County?

Neighbors can appear at the public participation meeting and both hearings, negotiate conditions, and challenge defective notice or an abuse of the zoning power. To sue, a neighbor must show a substantial interest and special damage and file within 30 days of the written decision. Opponents who gave $250 or more to a deciding official must disclose it before the first hearing.
