Land use, zoning, and rezoning attorneys for Hall County property owners and developers
Hall County requires a pre-application meeting before any rezoning, special use, conditional use, or variance is filed, and it is reinstating its Planning Commission on November 1, 2026 after a year in which the Board of Commissioners heard every case itself. Miles Hansford handles applications, hearings, and appeals in that process.
Hall County is planning for more than 383,000 residents by 2050, with growth focused on SR 365 in East Hall and I-985 in South Hall. We represent developers, landowners, and neighbors under the Hall County Forward plan, and work with our Hall County alcohol licensing attorneys when a restaurant or venue is part of the project.

Planning & Zoning intake, a pre-application meeting, then two public hearings
Hall County Planning & Zoning, on the third floor of the Government Center at 2875 Browns Bridge Road in Gainesville, accepts applications through the Accela online portal. Pre-application meetings are required before submitting any rezoning, special use, conditional use, or variance application; applicants bring a site plan and a narrative or statement of hardship. Staff then has 15 days to review a filed application.
Rezonings and special uses go to the Planning Commission for a recommendation and to the Board of Commissioners for decision. The Planning Commission takes final action on variances and conditional uses unless appealed. That structure was interrupted in October 2025, when the Board suspended the Planning Commission and heard every case itself; the county has announced the Planning Commission is reinstated effective November 1, 2026, with its first meeting on November 2, 2026.
- Mandatory pre-application meeting with a site plan and narrative
- Accela filing, staff review within 15 days
- Legal ad and sign 15 to 45 days before the hearing; posting affidavit 15 days before
- Planning Commission hearing, then Board of Commissioners hearing

How rezoning works in Hall County, and what has changed
Hall County's process is spelled out in a county guide, and 2025 and 2026 brought unusual changes to who hears the cases.
The Hall County process, step by step
Schedule the mandatory pre-application meeting with a site plan and narrative or statement of hardship. File through Accela; staff has 15 days to review. The legal ad runs and the sign goes up 15 to 45 days before the hearing, with the posting affidavit due 15 days before the first hearing; if the sign is not properly posted, the Board must table the request. For variances, staff mails letters to owners within 300 feet. The Planning Commission hears the case at a first- or third-Monday meeting, and the Board of Commissioners decides at a second- or fourth-Thursday voting meeting.
The Planning Commission suspension and reinstatement
Effective October 7, 2025, the Board of Commissioners suspended the Planning Commission to complete an investigation, and during the suspension the Board heard all rezoning, special use, conditional use, and variance requests directly. Three planners were removed after an Open Meetings Act investigation. The county now states the Planning Commission is reinstated effective November 1, 2026 and will begin hearing items on Monday, November 2, 2026, with a submission deadline of Friday, September 4, 2026 for that agenda.
Hall County Forward and the 2026 topics
The Hall County Forward comprehensive plan, scheduled for adoption in December 2024 to replace the 2017 plan, set six character areas and 14 future land use categories and called for a new unified development code with Agricultural General, Residential Mixed, and Mixed-Use districts. Growth corridors include SR 365 and the Inland Port in East Hall, I-985 in South Hall, US 129, SR 60, and SR 347. In 2026 the county has debated a draft data-center ordinance requiring a special use permit with sound, environmental, and traffic studies against a continued moratorium, proposed RSF and RTH residential districts, and started the next plan update in July 2026.
Opposing a rezoning and the 30-day appeal window
Opposition in Hall County starts before the hearing: a neighbor who documents traffic, drainage, or compatibility problems on the record at both hearings is far better placed later. To sue, a neighbor needs a substantial interest and special damage; defective notice and abuse of the zoning power are the usual grounds. A defeated rezoning cannot be reconsidered for six months under O.C.G.A. § 36-66-4(c). Any challenge must be filed in superior court within 30 days of the written decision under § 36-66-5.1: rezonings are reviewed de novo under a clear-and-convincing standard; variances, conditional uses, and special uses on the record.

Hall County zoning and rezoning FAQs
Do I need a pre-application meeting for a Hall County rezoning?
Yes. Hall County requires a pre-application meeting before submitting any rezoning, special use, conditional use, or variance application. Bring a site plan and a narrative, or a statement of hardship for a variance. Staff identifies the future land use designation, notice requirements, and fee range before you file through Accela.
Who decides rezonings in Hall County?
The Board of Commissioners decides rezonings and special uses after a Planning Commission recommendation. The Planning Commission takes final action on variances and conditional uses unless appealed to the Board. The Planning Commission was suspended in October 2025 and is reinstated effective November 1, 2026, so the path depends on filing date.
When does the Hall County Planning Commission meet?
The Planning Commission has met on the first and third Mondays at 5:15 p.m. at the Government Center. The reinstated board will hear its first items on Monday, November 2, 2026, with a submission deadline of Friday, September 4, 2026. The Board of Commissioners holds voting meetings on the second and fourth Thursdays at 6 p.m.
How much does a rezoning cost in Hall County?
Under the county's Planning & Zoning guide, rezoning fees run from $300 to $3,000 depending on acreage and district, variances from $250 to $2,000, and special uses from $250 to $2,500. An appeal of a Planning Commission decision to the Board of Commissioners is $200. Withdrawal refunds are 50% before public notice and 25% before the Planning Commission vote.
What notice does Hall County require before a zoning hearing?
The legal ad and the sign on the property must be in place not less than 15 and not more than 45 days before the hearing, and the posting affidavit is due 15 days before the first hearing. If the sign is not properly posted, the Board must table or delay the request. Variance applicants' neighbors within 300 feet receive mailed letters.
Is Hall County allowing data centers?
As of mid-2026 the county was weighing a draft data-center ordinance that would require a special use permit with sound, environmental, and traffic studies, against continuing its moratorium. Because a special use is reviewed on the record, the studies and testimony presented at the county hearing will decide any appeal.
How do I appeal a Hall County zoning decision?
A Planning Commission decision on a variance or conditional use can be appealed to the Board of Commissioners for a $200 fee. Any challenge to a final decision must be filed in superior court within 30 days under O.C.G.A. § 36-66-5.1. Rezonings are reviewed de novo under a clear-and-convincing standard; variances, conditional uses, and special uses on the record.
