Land Use & Zoning · Milton

Land use, zoning, and rezoning attorneys for Milton property owners and developers

Milton adopted a Unified Development Code in April 2024, then placed 2026 moratoria on AG-1 lot splits and data centers while it updates its comprehensive plan. Miles Hansford represents owners, builders, and neighbors through Milton's rezonings, use permits, variances, and appeals.

Milton is the most rural city in North Fulton and works hard to stay that way. Its code protects large AG-1 lots, steers commercial growth into form-based-code districts at Crabapple and Deerfield, and routes every rezoning through a Community Zoning Information Meeting, the Planning Commission, and the City Council. For restaurants and package stores that also need an alcohol license, see our Milton alcohol licensing page.

Crabapple & Deerfield Form-Based Codes

In these districts building form, frontage, and design govern more than the use table. We handle Design Review Board and Deerfield Ordinance phases.

Moratoria & Rural Preservation

AG-1 minor plats and data centers were both frozen in 2026. We advise on timing, exceptions, and vested rights.

How Milton Handles Zoning

A 2024 code, a rural plan, and four boards between filing and final vote

Milton's Community Development Department administers the Unified Development Code the City Council adopted unanimously on April 8, 2024. The UDC consolidated the former Chapter 64 zoning ordinance and Chapter 50 subdivision regulations and kept the Crabapple and Deerfield form-based codes; the city describes it as a technical reorganization with minimal policy change. A pre-application appointment with zoning staff is required before any rezoning, use permit, zoning modification, or variance is filed.

From there an application moves through a published annual schedule: the Design Review Board where design review applies, a Community Zoning Information Meeting for neighbors, the Planning Commission for a recommendation, and the City Council for the final decision. The Board of Zoning Appeals hears variances. Milton's fees, sign-posting rules, and mailed-notice periods change; confirm current figures with the firm.

  • Rezonings and concurrent variances
  • Use permits, including those required for brewpubs, breweries, and package stores
  • Hardship variances before the Board of Zoning Appeals
  • Design Review Board submittals and AG-1 minor subdivisions

In Depth

Rezoning in Milton: process, plan, and the 2026 moratoria

What owners and developers should know before filing in Milton.

The Milton rezoning process step by step

Every Milton rezoning, use permit, zoning modification, or variance starts with a pre-application appointment with the Zoning division, then is filed against the city's annual schedule. Design-district projects go to the Design Review Board first; a Community Zoning Information Meeting gives neighbors an informal look; the Planning Commission holds a public hearing and recommends; and the City Council holds the final hearing and votes, often with conditions. Georgia law requires newspaper notice 15 to 45 days before the hearing and a posted sign at least 15 days before.

Use permits, variances, and the form-based districts

Milton relies on use permits more than most cities. Since 2022, brewpubs, microbreweries, and off-premises distilled-spirits stores require one, and many other uses are conditional under the UDC. Use permits and variances are quasi-judicial, so the hearing record is what a court will review. Hardship variances go to the Board of Zoning Appeals.

In Crabapple, where Milton adopted its original form-based code in 2012, and in Deerfield along Highway 9, building form, frontage, and design govern more than the use table. Destination Deerfield is the city's plan to turn its most commercial district, with more than 550,000 square feet of vacant commercial space in October 2024, into a walkable mixed-use area through phased review: zoning or use permit, then design review, then building permit.

The comprehensive plan and the 2026 moratoria

Milton is refining its comprehensive plan in 2026; a public hearing was held August 3 and Council adoption is expected in October 2026. Georgia courts expect rezonings to be consistent with the plan, so a conflicting request may first need a plan amendment.

Two moratoria shape 2026 filings. A pause on minor subdivision plats on AG-1 land began in January 2026 and was extended February 9 for up to 120 days while staff proposed excluding lots under three acres; city case studies showed average house size above 5,200 square feet and average lots shrinking to 1.86 acres from 2021 to 2025. A data center moratorium adopted June 15, 2026 and extended in July bars acceptance of rezonings, permits, licenses, and certificates of occupancy for data centers while UDC amendments are drafted. Under Georgia vested-rights law, a moratorium cannot defeat a valid application already on file.

Opposing a rezoning and appealing a decision

Neighbors have three venues: the Community Zoning Information Meeting, the Planning Commission hearing, and the Council hearing. Effective opposition is specific, documented, and tied to the comprehensive plan or a notice defect. To sue, a neighbor must show special damage beyond what similarly situated owners suffer.

Under O.C.G.A. § 36-66-5.1, any challenge must be filed within 30 days of the written decision in Fulton County Superior Court. Constitutional challenges to legislative rezonings are heard de novo under a clear-and-convincing standard; use permits, variances, and administrative appeals are reviewed on the record by petition for review under O.C.G.A. § 5-3-1.

Frequently Asked Questions

Milton zoning and rezoning questions

Who decides rezonings in Milton, Georgia?

The Milton City Council makes the final decision after a public hearing. Before that, the Planning Commission holds its own hearing and recommends, and neighbors get an informal preview at a Community Zoning Information Meeting. Design districts also go through the Design Review Board.

Do I need a meeting with the city before filing a rezoning in Milton?

Yes. Milton requires a pre-application review appointment with the Zoning division before any rezoning, use permit, zoning modification, or variance is filed. We use that meeting to test the concept against the comprehensive plan and the Unified Development Code and learn which schedule the application will follow.

What is Milton's Unified Development Code?

The UDC is Milton's zoning and subdivision code, adopted unanimously by the City Council on April 8, 2024. It consolidated the former Chapter 64 zoning ordinance and Chapter 50 subdivision regulations and kept the Crabapple and Deerfield form-based codes. The city called it a technical reorganization with minimal policy change.

Can I split an AG-1 lot in Milton right now?

Not through a minor plat while a moratorium is in effect. Milton paused minor subdivision plats on AG-1 land in January 2026 and extended the pause on February 9 for up to 120 days while staff drafted rules excluding lots under three acres. Confirm the current status with the firm before you contract.

Is Milton accepting data center applications?

As of summer 2026, no. The City Council adopted a temporary data center moratorium on June 15, 2026, extended it July 6, and took up a further extension of up to 180 days on July 20 while it drafts UDC amendments. The resolution bars acceptance of rezonings, permits, licenses, and certificates of occupancy for data centers.

What is different about building in Crabapple or Deerfield?

Both districts use form-based codes, which regulate building form, frontage, and design more than use. Crabapple's code dates to 2012 and is the model for Destination Deerfield, the city's plan to convert the Highway 9 district into a walkable mixed-use area through phased review.

How can neighbors oppose a rezoning in Milton?

Attend the Community Zoning Information Meeting, the Planning Commission hearing, and the Council hearing, and put specific evidence on the record: comprehensive plan conflicts, traffic, and notice defects under O.C.G.A. § 36-66-4. To challenge an approval in court, a neighbor must show special damage and file within 30 days.

How long do I have to appeal a Milton zoning decision?

Thirty days from the written decision under O.C.G.A. § 36-66-5.1, filed in Fulton County Superior Court. Constitutional challenges to rezonings are heard de novo; use permits, variances, and administrative appeals are reviewed on the record by petition for review under O.C.G.A. § 5-3-1.
